SWEETSKINZ LIMITED WARRANTY
Sweetskinz Bicycle Tires
Limited Warranty: Sweetskinz warrants to the original retail purchaser (“Purchaser”) of every new SWEETSKINZ brand bicycle tire purchased from Sweetskinz directly, including but not limited to the Sweetskinz website (“Tire”) that the Tire will be free from defect in material and workmanship for the shorter of one year from date of purchase or until there is no serviceable original tread depth (as determined at the reasonable discretion of Sweetskinz) remaining on the Tire .
Remedy: Sweetskinz will replace the defective Tire with a comparable new SWEETSKINZ brand tire.
Exclusions: The Limited Warranty does not apply to damage or defects relating to: (1) road hazards (such as cuts, snags, punctures, or bruises), impact breaks, Tire plugs and/or repair, vandalism, accidents, or abusive or unusual operating conditions, fire and/or chemical corrosion; (2) improper operation or maintenance such as, but not limited to, under or over-inflation, load, speed and inflation practices resulting in excessive operational conditions; (3) improper sizing, wheel alignment, Tire mounting or rim fit; or (4) bicycle mechanical problems (such as faulty, worn, or malfunctioning brakes).
Warranty Disclaimer: Except as stated above, Sweetskinz hereby disclaims (and the Purchaser waives) all remedies, warranties, guarantees or liabilities concerning Sweetskinz products (including Tires) express or implied, existing or arising by law or otherwise (including, without limitation, any consequential damages), or whether or not occasioned by Sweetskinz’s negligence, including, without limitation, all implied warranties of merchantability, fitness for a particular purpose, infringement or otherwise.
Limitation of Remedy: Replacement of the Tire is the sole and exclusive remedy in the event of breach of any warranty or of any agreement relating to the Tire.
Limitation of Liability: In no event shall Sweetskinz be liable for any punitive, incidental, indirect, special or consequential damages or liabilities (including but not limited to incidental or consequential damages for loss of time, inconvenience, loss of use of bicycle, or any other consequential or incidental loss) in connection with the purchase, use, or operation of Sweetskinz products (including Tires), whether in contract, in tort, under any warranty, indemnity or otherwise, in excess of the purchase price of Sweetskinz products on which such claim is based.
Warranty Claim Procedure: Purchaser may make a claim under this Limited Warranty by contacting Sweetskinz via e-mail at returns@sweetskinz.com or via phone at (866) 204-9883 to obtain a return authorization number and shipping instructions. Return of Sweetskinz products without a return authorization number clearly marked on the outside of the package will not be accepted.
This Limited Warranty shall not be extended, altered or varied except by a written instrument signed by Sweetskinz.

SWEETSKINZ RETURNED GOODS POLICY (SS#-RMA)
SweetskinZ is dedicated to ensuring that its distributors receive the quality products that they purchased. Occasionally, goods may be shipped in error, damaged in transit (only if shipped FOB destination), be defective or be returned by the distributor’s customer as defective. The following policy and procedures are designed to provide the distributor with the information needed to return such products and either receive replacements or credits.
SweetskinZ has identified the following types of returns:

Goods shipped in error
Excess quantity shipped
Goods damaged in transit (only applies to goods shipped FOB destination)
Defective goods (not sold/shipped to customers)
Customer returns of defective good to distributor

For all of the above return types, the distributor must first contact SweetskinZ via e-mail at returns@sweetskinz.com or via phone at (866) 204-9883.

Goods Shipped In Error
If SweetskinZ has shipped the wrong goods, SweetskinZ will offer distributor the choice of returning the goods or accepting and paying for them. If distributor chooses to return the goods, SweetskinZ will issue distributor, via either e-mail or fax, a Return Material Authorization form (Form RMA-001) containing an RMA number that is unique for this order and will provide distributor with instructions for returning the goods.
SweetskinZ will pay the cost of the return shipping. SweetskinZ will also offer distributor the choice of receiving correct replacement goods or a credit for the purchase price. If distributor chooses to receive replacement goods, SweetskinZ will pay the shipping and handling cost. If distributor chooses to receive a credit for the purchase price, SweetskinZ will apply a credit to the distributor’s account for the purchase cost.

Excess Quantity Shipped
If SweetskinZ has shipped an excess quantity of any product, SweetskinZ will offer distributor the choice of returning the excess quantity or accepting and paying for the excess quantity. If distributor chooses to return the excess quantity, SweetskinZ will issue distributor, via either e-mail or fax, a Return Material Authorization form (Form RMA-001) containing an RMA number that is unique for this order and will provide distributor with instructions for returning the goods. SweetskinZ will pay the cost of the return shipping. SweetskinZ will also adjust the distributor’s invoice amount to reflect the excess quantity returned.

Goods Damaged in Transit (Goods Shipped FOB destination only)
If goods shipped FOB destination have been damaged in transit, SweetskinZ will issue distributor, via either e-mail or fax, a Return Material Authorization form (Form RMA-001) containing an RMA number that is unique for this order and will provide distributor with instructions for returning the goods. SweetskinZ will pay the cost of the return shipping.

NOTE: All items damaged in transit must be returned in the original shipping container, so distributor should not discard the container until distributor is certain distributor has received the goods undamaged. If the shipping container has been damaged to the point that it is not usable, distributor must supply a replacement container. However, the original container must still be returned to SweetskinZ. SweetskinZ will also provide distributor with a claim form that distributor must sign and return.

SweetskinZ will offer distributor the choice of receiving correct replacement goods or a credit for the purchase price. If distributor chooses to receive replacement goods, SweetskinZ will pay the shipping and handling cost. If distributor chooses to receive a credit for the purchase price, SweetskinZ will apply a credit to the distributor’s account for the purchase cost.

Defective Goods
NOTE: SweetskinZ replacement of defective goods is described more fully in Section 3 of the Authorized SweetskinZ Domestic Distributor Agreement. All requests for replacement of defective items are subject to these conditions.
Defective Goods (Not Sold/Shipped to Customers)
If SweetskinZ has shipped distributor defective goods that have not been sold or shipped to distributor’s customers, SweetskinZ will issue distributor, via either e-mail or fax, a Return Material Authorization form (Form RMA-001) containing an RMA number that is unique for this order. SweetskinZ will determine whether or not it wants distributor to destroy, hold or return the defective goods. If SweetskinZ wants distributor to return the defective goods, SweetskinZ will provide distributor with instructions for returning the goods. SweetskinZ will pay the cost of the return shipping.
SweetskinZ will offer distributor the choice of receiving replacement goods or a credit for the purchase price. If distributor chooses to receive replacement goods, SweetskinZ will pay the shipping and handling cost. If distributor chooses to receive a credit for the purchase price, SweetskinZ will apply a credit to the distributor’s account for the purchase cost.

Customer Returns of Defective Goods to Distributor
If distributor has received a return of goods from one of its customers and which the customer has declared defective, SweetskinZ will issue distributor, via either e-mail or fax, a Return Material Authorization form (Form RMA-001) containing an RMA number that is unique for this order. SweetskinZ will determine whether or not it wants distributor to destroy, hold or return the defective goods. If SweetskinZ wants distributor to return the defective goods, SweetskinZ will provide distributor with instructions for returning the goods. SweetskinZ will pay the cost of the return shipping.
SweetskinZ will offer distributor the choice of receiving replacement goods or a credit for the purchase price. If distributor chooses to receive replacement goods, SweetskinZ will pay the shipping and handling cost. If distributor chooses to receive a credit for the purchase price, SweetskinZ will apply a credit to the distributor’s account for the purchase cost.

SweetskinZ reserves the right to change or amend this policy at any time.
